TERMS OF SERVICE (FULL REWRITE)

OVERVIEW

Welcome to CanbusEmulator (“Company”, “we”, “us”, or “our”). This website is operated by CanbusEmulator and powered by Shopify, which enables us to provide our products and services (“Services”) to you.

By accessing or purchasing from our website, you agree to be bound by these Terms of Service (“Terms”), including any policies referenced herein. If you do not agree, you must not use our Services.

IMPORTANT LEGAL NOTICE – OFF-ROAD USE ONLY

All CAN bus emulator devices sold by CanbusEmulator are strictly intended for off-road, track, racing, export, research, or testing purposes only.

Our products:

  • Are not approved for use on public roads
  • May modify, disable, or simulate vehicle systems including but not limited to:
    • Diesel Particulate Filter (DPF)
    • AdBlue / SCR systems
    • Exhaust Gas Recirculation (EGR)

It is illegal in many jurisdictions to use such devices on public roads or in vehicles subject to emissions or road compliance testing.

By purchasing from us, you acknowledge and agree that:

  • You will use products only in compliance with all applicable laws
  • You are solely responsible for determining legal use in your jurisdiction
  • You assume all risk and liability arising from installation and use

We do not promote or condone illegal use of any product on public roads.

SECTION 1 – ELIGIBILITY

By placing an order, you confirm that:

  • You are at least 18 years of age
  • You are legally capable of entering into binding contracts
  • You understand the nature of off-road automotive components

SECTION 2 – PRODUCTS

We make every effort to ensure product descriptions are accurate; however:

  • Product specifications may change without notice
  • Images are for illustration purposes only
  • Compatibility is not guaranteed unless explicitly stated

It is the customer’s responsibility to verify compatibility before purchase.

Some products are manufactured to order. Where applicable, production begins immediately after purchase and may require up to 7 business days before dispatch.

All products are sold for off-road use only unless explicitly stated otherwise.

SECTION 3 – ORDERS

By placing an order, you are making an offer to purchase.

We reserve the right to:

  • Refuse or cancel any order at our discretion
  • Limit quantities
  • Cancel orders suspected of unlawful or improper intended use

Orders are not accepted until payment has been successfully processed.

For made-to-order products, cancellation requests may not be possible once production has started.

SECTION 4 – PRICING & PAYMENT

All prices are subject to change without notice.

Customers are responsible for:

  • Applicable taxes
  • Customs duties
  • Import fees
  • Compliance with local regulations

We are not responsible for goods seized or delayed by customs or regulatory authorities.

SECTION 5 – PRODUCTION, SHIPPING & RISK

All products are subject to a production period prior to dispatch.

Where applicable, production may take up to 7 business days.

Delivery times provided are estimates only and apply after production and dispatch.

Estimated delivery times (after dispatch):

  • UK: 2–5 business days
  • Europe: 3–7 business days
  • USA & Canada: 5–10 business days
  • Rest of World: 7–14 business days

Risk of loss transfers to the customer once the order is handed to the carrier.

We are not responsible for delays caused by:

  • Shipping carriers
  • Customs inspections
  • Regulatory checks
  • Local postal services

SECTION 6 – CANCELLATIONS & REFUNDS

All products are custom manufactured and made to order.

Under the Consumer Contracts Regulations 2013, goods that are made to a customer’s specification or clearly personalised may be exempt from the standard 14-day cancellation period.

As a result, we do not accept returns or cancellations for:

  • Change of mind
  • Incorrect ordering
  • Vehicle incompatibility not confirmed prior to purchase
  • Installed, used, modified, or damaged products
  • Electrical damage caused by incorrect installation or wiring

Customers are responsible for ensuring compatibility before purchase.

Where production has begun, cancellation requests may not be possible.

SECTION 7 – FAULTY OR DAMAGED ITEMS

All products are tested prior to dispatch.

If you believe your item is faulty or damaged, you must notify us within 14 days of delivery and provide:

  • Clear photo or video evidence
  • Installation details
  • Diagnostic information where applicable

If a manufacturing defect is confirmed, we will offer a repair or replacement in accordance with the Consumer Rights Act 2015.

If neither repair nor replacement is possible, a refund may be issued.

SECTION 8 – INSTALLATION & RESPONSIBILITY

Our products are designed for professional installation.

We are not responsible for issues resulting from:

  • Incorrect installation
  • Improper wiring or modification
  • Vehicle incompatibility not confirmed before purchase
  • Use outside intended application

Customers assume full responsibility for installation and use.

SECTION 9 – LEGAL COMPLIANCE & INDEMNITY

By purchasing and using our products, you agree that:

  • You are solely responsible for compliance with all applicable laws and regulations
  • You will not use products in violation of road, emissions, or environmental laws
  • You accept full responsibility for any consequences arising from use

You agree to indemnify and hold harmless CanbusEmulator from any claims, losses, penalties, fines, damages, or legal actions arising from misuse or unlawful use of products.

This includes, but is not limited to:

  • MOT or inspection failure
  • Emissions test failure
  • Legal enforcement actions
  • Vehicle damage
  • Financial losses

SECTION 10 – NO WARRANTIES

All products are provided “AS IS” and “AS AVAILABLE.”

To the fullest extent permitted by law, we disclaim all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Legal compliance in your jurisdiction
  • Uninterrupted or error-free operation

SECTION 11 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, CanbusEmulator shall not be liable for:

  • Indirect or consequential damages
  • Loss of vehicle use
  • Engine or component damage
  • Legal or regulatory penalties
  • Loss of profits or revenue

Total liability shall not exceed the amount paid for the product.

SECTION 12 – INTELLECTUAL PROPERTY

All content on this website, including text, logos, product descriptions, and design elements, is the property of CanbusEmulator and may not be copied or reproduced without written permission.

SECTION 13 – TERMINATION

We reserve the right to refuse service or terminate access to our website or Services at any time if we suspect misuse or violation of these Terms.

SECTION 14 – GOVERNING LAW

These Terms are governed by and interpreted in accordance with the laws of the United Kingdom.

SECTION 15 – CHANGES TO TERMS

We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of any changes.
